Scott, Hewitt & Mize, along with their attorney, John
Gannan, have filed a lawsuit against the City of Independence.
With the help of expert witnesses and use of vital evidence,
we plan on making the City of Independence accountable for
this deplorable taking of our property. We are hoping that
after this eminent domain trial is over, the city will think
twice before they use this kind of power against hard working
citizens for the benefit of wealthy out-of-town developers.
This type of "abuse of power" should not and can not be
tolerated by the citizens of Independence, Missouri.

Ground Breaking for the Independence Event Center
Scheduled for completion by the fall of next year, the
multi-purpose events center will be located in the Eastland
Center in Independence, Missouri and include luxury suites and
VIP seating along with restaurants, lounges and an attached
practice facility with a second ice surface for community use.
The nearly $60 million facility will be paid for by taxes
generated from a community improvement district established by
commercial businesses near the center.

Scott, Hewitt & Mize lost a part of there valuable property by
eminent domain back in 2003 by an approved city emergency
ordinance. This road was advertised by the City of Independence
Staff to the Mayor and City Council as a much needed road for a
public improvement. The truth is that the Developer William
Kidwell reimbursed the City of Independence for all costs to
take our valuable property by eminent domain. This happened
almost 5 years ago and the new road is 1/3 completed and is a
dead end street with a new city land fill at the end of the
street. It is pathetic how eminent domain is abused in
Independence Missouri.

William Kidwell, Kidwell Engineers and his hired contractors
find it perfectly fine to build a so called road as they wish

The one
year construction easement expired May 1st, 2006 and the city is
still allowing the developers construction crews to trespass
illegally on the Scott, Hewitt & Mize property. The city
attorney says they are no longer responsible. We will prove that
the city is still responsible and will be made accountable in a
court of law.

Take a ride on the Developers
Road that the City of Independence is claiming is a Public Road.
The first 450 foot of this road was taken from Scott, Hewitt
& Mize by way of eminent domain for the developer business park.
The developer is paying all the city's cost.

the one year construction easement expired by Scott,
Hewitt & Mize.
The video is the fencing installed with "No Trespassing"
signs posted to keep the Kidwell construction team off
the Scott Hewitt & Mize property. The city took the 1.13
acres of the Scott, Hewitt & Mize property well over a
year ago and gave Kidwell use of another 1/2 acre of the
Scott, Hewitt & Mize remaining property for one
year. The year is up and the road is nothing more than a
dirt bed as it has been for most the last year. Where is
the road that was promised the end of 2005? Where is the
road that is promised by June 1st of 2006 after a six
month extension was granted by the City of Independence?
Nothing but more unfulfilled promises by the developer
Kidwell.
